The following Terms and Conditions apply between you and  Toye Graphics Limited  (hereinafter "Gifts & Gadgets",  or "we/us"):



1. Conclusion of Contract


1.1. Our products presented Gifts & Gadgets solely represents a non-binding invitation for you to purchase merchandise from us.
1.2. By submitting your order, you submit a binding offer to conclude a sales contract with us.


1.3. We accept your offer by delivering the merchandise. The automatically generated order confirmation e-mail does not constitute acceptance of your offer. It merely documents the fact that we have received your order. We decide at our own discretion whether we will accept an order or not. We will notify you immediately in the event we do not intend to carry out your order.


1.4 While processing your order, we will inform you by e-mail if we determine that the products you have ordered are not available. No contract is concluded if the merchandise is not available.
1.5 We only sell our merchandise to end consumers who are 18 years of age or older and only in standard commercial quantities.


2.0 Acceptance of Terms
By accessing the content of www.giftsandgadgetsuk.com ('the Website') you agree to be bound by the terms and conditions set out herein and you accept our privacy policy.
If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately.
You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations.
You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website.
You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.
You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

3. Returns, Replacements and Refunds


3.1 Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel your order with us for a full refund at any time within 7 days, starting from the day after receiving email confirmation from us your order has been accepted.
3.2 You may return any goods you buy from us if they are received faulty or damaged in exchange for an identical replacement product to which you purchased.


3.3 Should you wish to cancel your order you must let us know in writing within 7 days of receiving your products and return them in the same condition that you received them. You must return the products:

- (a) within 7 days of receiving them;

- (b) with any original labels still attached, in their original packaging, and with the relevant return documents;

- (c) with the product packaging and documents in the same condition as when you received the product.

TERMS
1. You have 7 working days of receiving the package to test the product fully to see if it is a suitable purchase.
PLEASE NOTE: Do not send products back to us without it being Recorded Delivery, for more information please contact us to request a 'returns email instructions', as we will include specific instructions of how and where to send the returned product/s. Recorded Delivery is to track your return as we might request your tracking number!
2. You, the customer must then return the product within 7 working days. A 'returns email instructions' can be sent by us - please email us at info@giftsandgadgetsuk.com for more instructions.
3.4 Unfortunately, if you do not meet the return requirements in paragraph 3.3 above, we may charge you for the direct costs of recovering your products.


3.5 If you cancel your order under this paragraph 3. we will refund the payment you have made to us as soon as possible, and always within 30 days of you giving written notice of the cancellation, to info@giftsandgadgetsuk.com
 
4. Delivery/Shipping Costs

4.1 The minimum order amount is 1 unit.

Orders are shipped and delivery to your specified address in your order  within 28 working days after the order date unless otherwise stated in the terms and conditions of the product, subject to positive authorisation (creditworthiness check, identity verification).
 
4.2 We reserve the right to amend the postage charge to reflect the cost we are charged for delivering each item in line with what Gifts & Gadgets are charged by our courier services. Postage is charged by weight by our couriers to us and not by item.

5. Pricing and Payment Methods
5.1 The prices listed at the time the order is placed apply. All prices include legally applicable sales tax.
5.2 Merchandise may be paid for using one of the methods suggested in the order process under the terms and conditions outlined therein. Regardless of the result of the review of your data (identity verification and creditworthiness check), we reserve the right to exclude certain methods of payment.


5.3 We reserve the right to invoice you for late fees in the event that your payment is delayed. In case of payment delays, you agree to reimburse us for all the costs, expenses and cash expenditures we incur in the process of collecting payment. This also includes all extrajudicial costs for collection agencies or solicitors we entrust with the responsibility of collecting payment, notwithstanding the obligation to pay the costs of proceedings.



6. Reservation of Title


The merchandise remains our property until it is paid in full.



7. Warranty
Unless express provisions have been made to the contrary, the legal warranty regulations apply.




8. Copyright and Trademark
All of the contents of the website, including text, graphics, photos, images, videos, sounds, illustrations and software are the property of Gifts & Gadgets ltd or the property of affiliated companies, licensees and/or content providers. This content is protected by copyright and other laws. It may only be used with our express consent.

All trademarks used on the website are our trademarks provided nothing to the contrary is stated. They may not be used without our prior written approval.




9. Applicable Law


The laws of the United Kingdom apply to our contract relationship with you. Excluded from this provision are mandatory safeguards for customers in the country in which you reside. The United Nations Convention on Contracts for the International Sale of Goods is excluded.

10.0 Disclaimers
The information is provided on the understanding that the website is not engaged in rendering advice and should not be wholly relied upon when making any related decision.
The information contained with the Website is provided on an 'as is' basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website.
We do not guarantee uninterrupted availability of the www.giftsandgadgetsuk.com Website and cannot provide any representation that using the Website will be error free.

11.0Third Parties
The Website may contain hyperlinks to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content.

LIMITATION OF LIABILITY we will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.
